 Expert determination – Sale of Assets; Loss of Income; Pension Losses

The provision of a determination on whether, on the balance of probabilities, the defendant’s actions (deemed at fault), caused the selling of investment properties and the withdrawal of cash from a pension.

Once a causal link had been determined, the loss was calculated, providing an outcome that would put the claimant back into the position that they would have been in, had it not been for the defendant’s actions.

The determination was accepted by both parties.

Loss report – Business Interruption

Company T had to close its premises due to a non-damage denial of access incident.

Instructed by the claimant’s representatives, a report was provided setting out the losses that were caused by the closure of the premises.

In this case, the indemnified losses had to be separated from the overall losses suffered by the business at the time, due to the general economic conditions and a global travel ban.

This enabled a claim (that reflected the losses covered by an extension to a business insurance policy) to be submitted to the insurer and their loss adjusters.

Single Joint Expert – Valuation

The provision of a valuation of a trading business during a contentious dispute, providing the Court with an independent view of the financial situation of the company, a valuation and advice on how a financial settlement may be funded out of the business.

Commercial dispute – Loss of Profits

Company A submitted a counterclaim for loss of profits following an alleged breach of contract.

A loss report was provided demonstrating the losses that would have been incurred by the claimant following the alleged breach, along with the losses suffered by the defendant as part of the counterclaim, enabling a settlement to be reached.
